New York City building codes require property owners to build and maintain their properties under strict safety conditions, otherwise the Department will issue a violation when the property or construction does not comply with applicable laws and rules. If a property has an open violation, the owner may not be able to sell or mortgage.

Once the owner receives the property violation, he or she must appear before the court designated by the DOB; later at the hearing, it is defined whether the violation is sustained, in which case the corresponding Office will request payment of the fine. In most cases, it will be necessary to present a certificate of correction.

Upon submission of the Certificate of Correction, it will be necessary to file building plan applications with the DOB, obtain approval of the department’s plan, submit and extract permits, perform approved work, and approve final inspections. Only after the offending conditions are corrected can we work to have the plans signed and then submit the Certificate of Correction.
